Purchase Contract

UPON PAYMENT of the Purchase Price by the Buyer to Seller, receipt of which is hereby acknowledged, Seller grants, sells, conveys and transfers ownership of the following dog (the “Dog”) to Buyer:

General Information

Our miniature pinchers are honestly represented and have been evaluated as accurately as possible by a licensed veterinarian. To the best of our knowledge, the parents and the puppies are healthy, free from disease temperamentally and physically sound and are average specimen of the breed as presented in the breed standard. Vaccinations and deworming are current at the time of sale. The puppy you have placed on hold with us will be the puppy you will receive.

Deposit/ Payment

We cannot place a puppy on hold without a deposit. No puppy is considered reserved unless we receive your purchase agreement AND your deposit for your puppy. This deposit signifies the intent on the part of the buyer to follow through with the purchase of the puppy.

Upon receipt of your deposit and purchase agreement, your puppy will be taken offline and held for you until he/she is ready to come home.

The balance owed on the puppy is due by 7 weeks of age or one week prior to travel. Failure on the behalf of the buyer to receive the balance owed by the specified date or have your puppy paid in full by the time he/she is 7 weeks old will forfeiture of all payments and any rights the potential buyer has towards the puppy or any other puppy.

If for some reason, you find yourself unable to take the puppy we have held for you home, we will gladly transfer your payment to a different puppy that we may have available at another time and you can transfer it to someone else if you choose. The deposit is non-refundable.

Refunds

The deposit, any services rendered and any shipping fees (where applicable) are non-refundable, unless we cannot provide the puppy you have chosen due to unforeseen circumstances. We do not offer refunds. No money will be refunded.

We will not refund money nor pay anyone's vet bills. We work hard to provide a healthy pet companion but are not responsible for other vets' opinions. It is your responsibility financially to continue regular checkups, vaccinations, etc. at your veterinarian clinic. The seller is not responsible for any medical, dental or surgical procedures to maintain a dog's health or wellbeing after the buyer assumes ownership.

Returns/ Rehoming/ Owner Surrender

If for any reason you are not able to keep your pet companion, we (as the breeder) reserve first rights to the puppy. We will help you find a home for the puppy/dog or take them back at any time during his/her life. No refund will be offered at this time.

Our puppies are considered the property of GA Min Pin Kennel if the original buyer can no longer retain possession. The dog will be returned in good health with all paperwork including registration papers and medical records to GA Min Pin Kennel within 14 days.

Under no circumstances will the buyer rehome the dog or allow him/her to be surrendered to the pound or any rescue center.

Rehoming of our puppy without our written permission is considered a breach of contract and the buyer will take the appropriate legal steps to regain possession of the dog or the buyer will be charged for the actual value of the puppy at the time of the original sale (purchase price) and any fees incurred to regain possession of the dog.

GA Min Pin Kennel is not responsible for shipping charges to transport a puppy (original, return or replacement) back and forth in the event of a return or replacement for any reason.

Replacement

Should an unexpected, fatal accident happen to the puppy while the puppy is in our care, we will replace the puppy at our discretion with another puppy as soon as one becomes available.

Replacement of the puppy is the sole discretion of GA Min Pin Kennel. A replacement puppy is subject to availability, breeder's first choice for our breeding program, etc.

Buyer understands that a replacement puppy is ONLY to be given if a valid hereditary problem is found. Buyer understands that the replacement puppy may not be of the same sex, age, from the same parents etc.

In the event that no puppies are available at that time to replace your puppy, the buyer will be placed on a waiting list and will be notified when a puppy of comparable breed, value etc. becomes available.

Please call us for advice and we will evaluate all problems on a case by case basis. GA Min Pin Kennel will not replace a puppy that dies because the new owner waited too long to get medical attention for the new puppy; if the puppy was dropped or injured maliciously; OR where neglect or abuse by the new owner or misdiagnosis by the buyer’s vet could have caused the problem.

Failure on the behalf of the buyer to cooperate and respond to our phone calls, emails, etc. within a specified time frame cancels the transaction of a replacement puppy.

GA Min Pin Kennel is not responsible for shipping charges to transport a puppy (original, return or replacement) back & forth in the event of a return or replacement for any reason.

If the buyer wishes the retain the original puppy, he or she waives the right to a replacement puppy unless otherwise agreed upon in writing from the seller, stating that the buyer may keep the original puppy and also receive the replacement puppy.

At the discretion of GA Min Pin Kennel, if you are a breeder, any undescended testicles must be diagnosed by your vet at your puppy's initial/ first visit (within 72 hours of receiving the puppy). If this does happen, the buyer can return the puppy within 72 hours of the purchase at the buyer's expense for a replacement puppy at the discretion of GA Min Pin Kennel. NO replacement if the puppy will not be used for breeding or if the buyer received a limited registration.

If the puppy doesn't pass his/her 72 hour health exam, the buyer must notify the seller immediately, within the first 72 hour time period or this contract is deemed null & void.

In the event that the buyer returns the puppy at this time, he/she must be returned within 7 calendar days of the purchase date with all of his/her paperwork, registration papers, health records etc.

Registration

*** Note: We are selling our puppies as companions (with limited registration), not for breeding, unless otherwise stated on your contract. We do require an additional fee for full registration and breeding rights. Please contact us, for more information about this. Thank you.***

Limited Registration

The buyer also agrees that the puppy is not allowed to breed under any circumstances and must be spayed/neutered. If for any reason it is discover that the puppy/dog remains unaltered and was used for any type of breeding (producing a litter of puppies either as purposely bred or by an accidental breeding), GA Min Pin Kennel has the right to seek compensation in the amount $5,000, all rights to the dogs and all offspring produced with no compensation to the buyer.

If you have a full registration/ breeding right from us, we recommend that you do not breed your dog before he/she has been cleared with a clean bill of health.

Shipping/ Delays/ Weather

We offer a safe, easy and affordable shipping experience; with an emphasis on making your puppy a priority. We can ship your puppy to any major airport in the US.

*** Note: We do not ship puppies before 8 weeks of age. If your puppy is coming home during the winter or summer months, there is a chance that his or her flight will be postponed, due to cold or hot weather. ***

If it is not safe to release the puppy due to the weather, size of the puppy OR other unsafe situations, GA Min Pin Kennel reserves the right to move the travel date at our discretion. In this situation, the next available ship date will be chosen. You'll be notified via email or by phone if a schedule change occurs.

*** Avoid unexpected flight delays. More information on the flight schedule will be provided prior to shipping with the AWB number you can use to track the incoming flight status on the airline's website your puppy is traveling with prior to driving to the airport.***

Puppy's Size at Time of Travel

*** Note: If your puppy is small at 8 weeks old and we are concerned about him/her traveling, we may decide to hold it for additional weeks to ensure he/she is big enough to travel. The health, safety and happiness of our puppies is very important to us.***

Your Responsibility

By taking ownership of one of our puppies, you agree that:

You will never rehome the puppy OR allow the puppy to end up in a shelter or rescue.
Provide good care for your new puppy, by spaying or neutering it, unless otherwise stated on your contract.
If the puppy doesn't pass his/her 72 hour health exam, the buyer must notify the seller immediately, within the first 72 hour time period or this contract is deemed null and void. In the event that the buyer returns the puppy at this time, he/she must be returned within 7 calendar days of the purchase date with all of his or her paperwork, registration papers, health records etc.
Buyer will not take the puppy to public areas where dogs are known the frequent until ALL of the puppy vaccinations are given; nor to visit homes of family or friends who knowingly had a puppy infected with parvovirus as this disease can live in an environment for many years.
To continue regular checkups, vaccinations, etc. at your veterinary clinic. The most important thing you can do for the good health of your puppy is to complete the worming and vaccinations needed to ensure your puppy continues to enjoy good health. Your vet will set you up on a schedule for this, so follow their advice. We cannot guarantee total immunity for your puppy when he/she first comes home to you as the shots he or she has received are just a few in a series and your vet will need to complete the remaining vaccinations in a timely fashion.
To provide lifelong commitment, a comfortable environment, proper housing, proper nutrition, fresh water available at all times, prompt medical attention, proper grooming, good quality food, love, attention, time, adequate exercise, responsible care, etc. for the dog. This includes keeping the dog parasite free, an annual teeth cleaning and be up to date on all vaccinations to ensure longevity of life.
To provide a safe environment for the dog and never allow the dog to roam freely without proper fencing or supervision.
To tie the dog to a chain, leave outside unattended, mistreat or, encourage aggression or viciousness. Rough play is not allowed as it encourages aggressive behavior.
To euthanize the dog for any reason unless it is life threatening illness or injury. In this instance, documentation must be provided to the seller by the attending veterinarian.
To review information on the dog breed, including information on temperament, exercise, grooming, feeding, training & common medical conditions that affect the breed.

This contract is void if the buyer fails to provide the required immunizations, wormer and medical treatment for their puppy. This contract is null and void if the dog is overweight or underweight while in your care.

Buyer assumes all responsibility for the puppy upon its arrival in their home. GA Min Pin Kennel is not responsible and cannot be held liable for a puppy's personality, health (vision, dental, etc.), temperament, training (or lack thereof), disposition or actions once the puppy is in your care. Dogs depend on a kind owner that will take care of them and love them. If your dog doesn't receive the time, exercise, love and attention that he/she deserves, bad vices and behaviors can develop due to boredom, neglect and/or abuse.

After Your Puppy Comes Home

If you think your puppy is sick when he/she arrives, please call us immediately or you may void this agreement. If it is an emergency, take the puppy to the vet immediately and contact us when you arrive.

The seller is not responsible for any medical, dental or surgical procedures to maintain a dog's health or wellbeing after the buyer assumes ownership.

Food Recommendations

How you feed your puppy is very important. Follow your vet's advice for what brand of food to feed your dog and what amount he or she needs daily. We recommend feeding them a top-quality brand. Remember that just like humans, dogs are what they eat!

Litigation/ Court Fees

All attorney fees involved in fulfilling this contract are the responsibility of the buyer, as well as all lodging, legal, court costs, transportation, shipping fees, etc.in the event of a legal dispute.

In the event of a legal dispute, the buyer agrees to return the puppy to the seller until all court proceedings are finalized. It is further agreed upon that the place of venue shall be Fulton County, Georgia.

The buyer releases and holds harmless GA Min Pin Kennel from all legal litigation and any/ all liabilities (accidental fall, dog bite, etc.) that might occur while attending and/or participating in any events/activities on the buyer's property.

Non-transferrable

This contract is non-transferable in the event that the buyer decides to sell the puppy. This contract is only valid you received your puppy directly from us (no third party involved).

Miscellaneous

All previous drafts of this contract are invalid. The current contract supersedes any and all previous agreements. This contract is null and void if all terms and conditions are not fulfilled by buyer.

This is considered to be a complete bill of sale. This is the total agreement between the buyer and seller. No other terms or conditions are valid to this sale.

This contract is deemed to be a legally binding contract and is under the jurisdiction of the State of Georgia, in the county of Fulton. State of Georgia rules and regulations concerning the sale of animals apply to this sale and govern all warranties and guarantees.

It is agreed that if the buyer breaches any part of this contract, the seller has full rights to pursue a civil lawsuit for breach of contract damages in the amount of $5,000.

As the breeder, we reserve the right to refuse to sell a puppy to an individual and cancel the sale of any puppy at any time, up until he/she arrives at your home, for any reason we deem appropriate.

The buyer hereby acknowledges upon receipt of the puppy that he/she has read, agrees to the terms and accepts full responsibility for the health and wellbeing of the purchased puppy.
